Agreement and Release from Liability

- I, or on behalf of , acknowledge that I have voluntarily agreed to engage and otherwise participate in the practice of Martial Arts Sparring as offered at Ortiz Martial Arts Academy.
- I understand this type of sporting practice is inherently dangerous, regardless of the level of supervision. Injuries may occur due to physical situations or a combination of any number of circumstances. It is clear to me that any amount of time spent engaging in this activity only makes it more likely that, as in any sport, injury may well occur at some time. Any person training Martial Arts, or in activities connected with Martial Arts, or participating in any activity carried on by the Club/Academy is only allowed to do so on the distinct understanding that they do so entirely at their own risk.
- In all other cases and except where inconsistent with the above, the Applicant for him/herself, his/her executors, administrators, dependents and other personal representatives, hereby absolves and indemnifies and providers and all their servants, agents, employees, and other students or persons under the providers' control (the "indemnifies") from all liability howsoever arising for injury or damage (including but not limited to the Applicants' person, whether fatal or otherwise, property and personal belongings) however caused by the negligence of the indemnified, arising out of or participating in Martial Arts or connection with Martial Arts or in any way caused by, arising out of, any activity carried on by the indemnified.
- I, the Applicant, have been advised and understand that the practice of Martial Arts is potentially dangerous.
- I, the Applicant, agree the premises of 50/5 Ponderosa Parade, Warriewood - Leased by Ortiz Martial Arts Academy at risk to myself and release to the full extent permitted by law Edson Ortiz, Ortiz Martial Arts Academy, and its agents, servants, contractors, and employees from all claims and demands of every kind in of or resulting from any accident or damage to property or injury or death to myself while undertaking training in Martial Arts with Ortiz Martial Arts Academy.
- I, the Applicant, agree to receive emails, surveys, and any other type of contact material from the Ortiz Martial Arts Academy. I understand that my details will not be sold, or given to any other person outside the Ortiz Martial Arts Academy. I am aware that I can unsubscribe from any material that is sent to me or the applicant.
- I hereby irrevocably consent the Ortiz Martial Arts Academy and its affiliates to use my or the Applicant's name and photographs, sound, and film recordings taken of myself during the course for the promotion of the Ortiz Martial Arts Academy services and initiatives to the media and general public.
- I'm aware that I have to provide a copy of "Proof of Identity" which shows a picture, full name, actual address, and signature.
The Applicant agrees that he/she is in no way qualified or authorized to teach Martial Arts or privately in any way whatsoever for personal, monetary, or any form of gain whatsoever unless with the written authorization of a Director from Ortiz Martial Arts Academy.
I have read these Terms and Conditions and by signing this form I accept all the terms applied including the Rules and Etiquettes of the Ortiz Martial Arts Academy.
I have carefully read this agreement and fully understand its contents. I am aware that this is a release of liability and that it forms a contract between myself and Ortiz Martial Arts Academy, its agents, instructors, and employees, and I sign it for my own free will.
